Hi

The US Trademark Electronics Search System (TESS) returns the following
for APRS:

Typed Drawing
--------------------------------------------------------------------------

Word Mark APRS
Goods and Services IC 009. US 021 023 026 036 038. G & S: series of
computer software for transmitting and receiving digital radio
communications. FIRST USE: 19930100. FIRST USE IN COMMERCE: 19930510
Mark Drawing Code (1) TYPED DRAWING
Serial Number 75022429
Filing Date November 20, 1995
Current Filing Basis 1A
Original Filing Basis 1A
Published for Opposition February 11, 1997
Registration Number 2058846
Registration Date May 6, 1997

Affidavit Text SECT 15. SECT 8 (6-YR). SECTION 8(10-YR) 20070707.
Renewal 1ST RENEWAL 20070707
Live/Dead Indicator LIVE

So YES you should assign the T in a circle mark to the APRS acronym when
referring to Amateur Packet radio System.

Also - not listed in UK, European Union databases - searching other
non-English based databases is problematic :-)

Cheers

Hi

Trademark - from the IP Australia Website (responsible for Trademarks and
such)

"A registered trade mark gives you the legal right to use, license or sell
it within Australia for the goods and services for which it is
registered."

It goes on to talk about all sorts of other stuff which isinteresting to
those who want to know all about trademarks etc.

you can also use their search engine ATMOSS to search for trademarks -
aprs does not appear in the register.

Copyright - from the Australian Copyright Council

"Copyright is a type of legal protection for people who express ideas and
information in certain forms. The most common forms are: writing, visual
images, music and moving images..............Copyright protects the form
or way an idea or information is expressed, not the idea or information
itself."

I'm pretty sure APRS is a registered Trademark of Bob Bruninga WB4APR....
I've seen that stated on several presentations and have also been using it
on some of mine recently...... Hope it's right :-)

Hi to all on the group.

Just a question on the term "APRS" should this be represented as a
trademark
T or as a copyright C or maybe as a registered item R

I've done a little research but am unable to resolve this.

Now I know that from time to time Bob Bruninga does monitor this forum.

Any cluse would be appreciated! (this is for use on the VK7 APRS Website)

I am pretty sure that APRS is NOT a registered Trademark in AUSTRALIA.
Registered Trademarks are for the country of registration only

Darryl,

Would the free trade agreement with the US have an impact on TM?

No... I believe that Trademarks still need to be separately registered in
each jurisdiction

Geoff,

At the Orange club meeting last Friday you mentioned it might be possible
for Orange Club to have their website hosted on one of your servers.

I was just wondering if you could give me the details for that so that I
can
get it happening there. Simon (whom you did not meet as was absent from
the
meeting) is happy to use the hosting he bought for another website he is
doing and thus it would work out very nicely indeed.

Let me know anything you need and we can get this happening :)

Cheers,

Bob

Actually trademarks do transcend borders, especially if they are lodged
under the WIPO Madrid Protocol.

Although the US is a special case, costing a bit more to register, that
is,
if you register a trademark in Australia, then lodge an worldwide
application via the Worldwide Intellectual Property Organisation there is
a
special extra bit to pay to have the trademark similarly protected in the
US.

Probably a little off topic, just so happens I am in the process of going
through registering a few worldwide trademarks for my employer.

It's no problem to use the APRS trademark in your presentations, just as
long as you don't try and pinch it from Bob and try to make money out of
it.

There's generally a lot of confusion about IP and trademarks and other
such protections.

You can't make your own drink and call it Coca-Cola, but you can
refer to the Coca-Cola product using the trademark without requesting
permission.

Similarly, you are allowed to use the APRS trademark to refer to APRS,
without any requirement to get permission. If your product works with APRS

or is compatible with APRS then you may use the mark, in commercial
applications.

You may not use the trademark to represent something that is not APRS
though.

I don't think you will be able to copyright APRS. You could apply to
trademark it (buts its expensve and very time consuming). I think you
would
need to protect it in every jurisdiction, so it may not be protected in VK
I
can send you some IP lectures if you are interested in the topic. I did
not
do that option in my degree.
